1.2 Eligibility

Use of the Site is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. You must be at least 18 years of age or have the express written consent of a parent or legal guardian. By placing an order, you represent and warrant that you meet this requirement. ShopGenie does not knowingly provide services to minors and reserves the right to terminate any account created in violation of this clause.

1.3 Company Information

In compliance with Rule 5(3) of the Consumer Protection (E-Commerce) Rules, 2020, the above information is displayed prominently. ShopGenie is registered under the laws of India and operates as an inventory-based e-commerce entity specialising in imported and domestic consumer goods.

1.4 Account Registration

To access certain features, you may register for an account. You are responsible for maintaining the confidentiality of your account credentials and two-factor authentication methods, and for all activities that occur under your account. You must provide accurate, current, and complete information. You agree to notify us immediately at shopgenie.info@gmail.com of any unauthorised use. ShopGenie reserves the right to suspend or terminate accounts that violate these Terms, are associated with fraudulent activity, or whose credentials are suspected to have been compromised.

1.5 Product Information and Pricing

We strive to display our products and prices accurately, but errors may occur. All prices are displayed in Indian Rupees (INR) and include applicable Goods and Services Tax (GST) unless stated otherwise. Prices are subject to change without prior notice. ShopGenie reserves the right to correct pricing errors and to cancel or refuse orders placed at an incorrect price, in which case a full refund will be issued within 5 business days. We do not warrant that product descriptions, images, specifications, or other content are entirely accurate, complete, or error-free.

1.6 Imported Products – Important Disclosure

The following conditions apply to all imported products:

• •Delivery timelines for imported products typically range from 2 to 3 weeks from the date of order confirmation, and may extend to one calendar month depending on customs clearance, international shipping schedules, and supplier processing times.
• •Product manuals, labels, or packaging may be in the language of the country of origin. ShopGenie will endeavour to provide translated summaries for critical usage instructions where applicable.
• •Electrical and electronic products may be manufactured to the voltage, plug type, or certification standards of the country of origin. You must verify compatibility with Indian electrical standards (230V / 50Hz, IS 1293 plug type) before ordering. ShopGenie accepts no liability for damage caused by incompatible voltage or plug configuration.
• •The country of origin of each imported product is displayed on its individual product listing page, in compliance with Rule 6(1) of the Consumer Protection (E-Commerce) Rules, 2020, and the Legal Metrology (Packaged Commodities) Rules, 2011.
• •ShopGenie acts as the importer of record for all imported products. Our details as importer are: ShopGenie, [Registered Address], Mumbai, India.

1.7 Placing Orders and Order Acceptance

Your receipt of an order confirmation email or an order number does not signify ShopGenie's acceptance of your order. We reserve the right to accept or decline any order, at any time after receipt, for reasons including but not limited to: the product being out of stock, concerns about fraud or payment integrity, a pricing error, inability to obtain payment authorisation, or any other business reason at our sole discretion. In all cases of declined orders, we will notify you and process any charged amounts as a full refund within 5 business days.

1.8 Cancellation Policy

Before Shipping:

You may cancel your order free of charge at any time before it has been dispatched by contacting us at shopgenie.info@gmail.com or calling +91 9022970269 during business hours (Monday to Saturday, 10:00 AM – 8:00 PM IST). A full refund will be processed to the original payment method within 5–10 business days of cancellation confirmation.

After Dispatch – Domestic Products:

Once a domestic product has been dispatched, it cannot be cancelled. Our standard Returns and Exchange Policy (Section 4 of this document) applies.

After Dispatch – Imported Products:

Orders for imported products cannot be cancelled once the product has been dispatched from our international supplier. This is because ShopGenie incurs irrevocable customs, logistics, and procurement costs at that stage. You will be notified by email when this point is reached, which typically occurs within 24 to 48 hours of order placement. We strongly encourage you to review your order carefully before confirming purchase.

1.9 Customs, Duties, and Taxes

ShopGenie handles all customs clearance procedures on your behalf. In rare cases where customs authorities require additional documentation from the recipient (such as a government-issued ID or a self-declaration), we will contact you promptly. Failure to provide such documentation within the stipulated time may result in the package being detained or returned, in which case our Undeliverable Packages policy (Section 3.5) applies.

1.10 Payment Terms

We accept the following payment methods:

By providing payment information, you represent and warrant that you are authorised to use the designated payment method and that the information you provide is accurate. You authorise ShopGenie to charge your payment method for the total amount of your order, including shipping charges and applicable taxes. All transactions are processed through PCI-DSS compliant third-party payment gateways. ShopGenie does not store complete credit card, debit card, or net banking credentials on its own servers.

1.11 Intellectual Property Rights

All content on the Site – including text, graphics, logos, images, product photographs, software, and data compilations – is the property of ShopGenie or its licensed content suppliers and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international intellectual property treaties. You may not reproduce, distribute, publicly display, or create derivative works from any content on the Site without our express prior written permission. Systematic extraction or scraping of Site content is strictly prohibited.

1.12 User-Generated Content

You may post reviews, ratings, and other communications on the Site, provided such content is lawful, accurate, and not defamatory, obscene, threatening, or in violation of any third party's intellectual property rights. By posting content, you grant ShopGenie a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, modify, adapt, publish, and distribute that content across all media. ShopGenie assumes no liability for user-generated content but reserves the right to remove any content at its sole discretion.

1.13 Limitation of Liability

To the fullest extent permitted by Indian law, ShopGenie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (i) your use of or inability to use the Site; (ii) any conduct or content of any third party on the Site; (iii) delays in delivery due to customs clearance, international shipping disruptions, or force majeure events.

The aggregate liability of ShopGenie to you for any claim arising from any transaction shall not exceed the total amount paid by you for that specific transaction. This limitation does not exclude or restrict ShopGenie's liability for death or personal injury resulting directly from its own gross negligence, fraud, or fraudulent misrepresentation, as required under Indian law.

1.14 Disclaimer of Warranties

The Site and all products and services are provided on an 'AS IS' and 'AS AVAILABLE' basis. ShopGenie makes no representation or warranty, express or implied, that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. To the extent permitted by law, ShopGenie disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose.

1.15 Indemnification

You agree to indemnify, defend, and hold harmless ShopGenie, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Site, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

1.16 Severability and Force Majeure

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions. ShopGenie shall not be held liable for any delay or failure in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemics, strikes, wars, government embargoes, cyber attacks, or failures of third-party logistics networks ('Force Majeure').

1.17 Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.

1.18 Changes to These Terms

ShopGenie reserves the right to update or modify these Terms at any time. The updated Terms will be posted on this page with the revised 'Last Updated' date. Your continued use of the Site after any such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

1.19 Grievance Officer

In compliance with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000.
